These Terms of Service (the “Terms”) govern your access to and use of the Stoqx.ai website and application (the “Service”), operated by Stoqx.ai (“we”, “us”, or “our”) from India. By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
Stoqx.ai is not financial advice. Everything in the Service — including AI-generated signals, scores, screeners, and commentary — is provided for informational and educational purposes only. It is not investment, financial, legal, or tax advice, and it is not a recommendation or solicitation to buy or sell any security. Investing involves risk, including the possible loss of principal. You are solely responsible for your own investment decisions, and you should consult a licensed financial adviser before acting.
1. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to use the Service. By using it, you represent that you meet these requirements and that your use complies with the laws that apply to you. If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.
2. Your account
You need an account to use most of the Service. You may create one directly or by signing in with Google. You agree to provide accurate information, keep it current, and keep your credentials confidential. You are responsible for all activity that happens under your account. Tell us promptly at [email protected] if you suspect unauthorised use.
Accounts are for a single person. Do not share, sell, or transfer your account, and do not create an account on behalf of someone else without their permission.
3. Early access and changes to the Service
The Service is currently in early access and is offered free of charge. Early-access software may contain bugs, may be incomplete, and may change substantially. We may add, modify, suspend, or discontinue any feature at any time, and we may introduce paid plans in the future. If we start charging for features you currently use for free, we will give you advance notice and the choice to accept the new terms or stop using those features. Nothing here obliges us to keep any feature free permanently.
4. Acceptable use
You agree not to:
- use the Service for any unlawful purpose, including market manipulation, insider dealing, or any activity that violates securities laws;
- scrape, crawl, harvest, or bulk-export data from the Service, or use automated means to access it beyond any documented API;
- resell, redistribute, sublicense, or commercially exploit market data or AI output obtained from the Service;
- reverse engineer, decompile, or attempt to derive the source code or underlying models of the Service, except to the extent this restriction is prohibited by law;
- probe, scan, or test the vulnerability of our systems, circumvent authentication or rate limits, or interfere with the Service's operation or other users' access;
- upload malware, or submit content that is unlawful, infringing, or abusive; or
- misrepresent AI output from the Service as professional financial advice to others.
We may investigate suspected violations and suspend or terminate access in response.
5. Your content
You keep ownership of the watchlists, notes, settings, and other content you create in the Service (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and process Your Content solely to operate and improve the Service and to provide support. This licence ends when you delete Your Content or your account, except for copies retained in backups for the periods described in our Privacy Policy.
You are responsible for Your Content and represent that you have the rights to submit it.
6. Our intellectual property
The Service, including its software, design, branding, text, graphics, and the Stoqx.ai name and logo, is owned by us or our licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial research. No other rights are granted, whether by implication or otherwise.
If you send us feedback or suggestions, we may use them without restriction or obligation to you.
7. Market data and third-party content
Prices, fundamentals, news, and other market data are supplied by third-party providers and exchanges. This data may be delayed, incomplete, or inaccurate, and it remains the property of its providers, who may impose their own terms and usage restrictions. We are not the source of this data and do not guarantee its accuracy, timeliness, or availability. Do not rely on the Service for time-critical trading decisions.
8. AI-generated output
The Service uses AI models to summarise information and generate signals and scores. AI output is probabilistic: it can be incomplete, outdated, or simply wrong, and confidence scores are estimates rather than guarantees. Similar inputs may produce different outputs. Always verify AI output against primary sources before acting on it. Past performance of any signal, strategy, or security does not predict future results.
9. Third-party services
The Service may integrate with or link to third-party services, such as Google Sign-In. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.
10. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that any information or output obtained through the Service will be accurate or profitable.
11. Limitation of liability
To the maximum extent permitted by law, Stoqx.ai and its directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, trading losses, investment losses, revenue, data, goodwill, or business opportunity, arising out of or relating to your use of or inability to use the Service — even if we have been advised of the possibility of such damages.
Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or (b) INR 5,000. Because the Service is currently free, this will usually mean INR 5,000.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities, so some of the above may not apply to you. Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, or anything else that cannot lawfully be limited.
12. Indemnity
You agree to indemnify and hold harmless Stoqx.ai and its personnel from any claims, damages, liabilities, and reasonable legal fees arising from your use of the Service, Your Content, your violation of these Terms, or your violation of any law or third-party right.
13. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if your use creates risk or legal exposure for us or other users, or if we discontinue the Service. Where practical we will give you notice. On termination, your licence to use the Service ends immediately; sections that by their nature should survive — including sections 5 to 12, 14, and 15 — will survive.
14. Changes to these Terms
We may update these Terms from time to time. We will revise the effective date above and, for material changes, give you notice in the app or by email before they take effect. If you continue to use the Service after the change takes effect, you accept the updated Terms. If you do not agree, stop using the Service and delete your account.
15. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-law rules. You and we agree that the courts of India will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, subject to any mandatory rights you have as a consumer to bring proceedings in your country of residence.
16. General
These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.
